1. Agreement to Terms
This Terms of Service agreement ("Terms") governs your use of the jacksimontrades.com website (the "Site") and the subscription services provided by Jack Simon Trades, LLC ("JST", "us", "we", or "our"). By accessing the Site or subscribing to our service, you agree to be bound by these Terms, and our Privacy Policy. If you do not agree with these Terms, you must not use our Service.
2. Subscription, Billing, and Cancellation
Your subscription will automatically renew at the end of your chosen billing cycle (either monthly or annually) unless you cancel. You can cancel your subscription at any time by logging into your account dashboard and following the cancellation instructions. Upon cancellation, your access to the service will continue until the end of your current paid billing period.
3. Refund Policy
Due to the immediate and irreversible delivery of proprietary digital information upon subscribing, we do not offer refunds. All sales are final.
4. Intellectual Property
All content provided on the Site and through the Service, including but not limited to text, graphics, logos, the trading model, and the signals themselves, is the property of JST and is protected by copyright and other intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or redistribute any portion of the Service or its content without our express written permission.
5. Disclaimer of Warranties
JST MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE INFORMATION PROVIDED. ALL INFORMATION PROVIDED IS ON AN “AS IS”, “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER TO THE FULLEST EXTENT PERMITTED BY LAW. JST DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, ARISING BY STATUTE, CUSTOM, COURSE OF DEALING, COURSE OF PERFORMANCE OR IN ANY OTHER WAY. JST DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION PROVIDED OR THAT THE CONTENT OF THE INFORMATION PROVIDED IS ACCURATE, COMPLETE OR CURRENT. JST DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION AND ANY TRANSMISSIONS SENT FROM JST IS FREE OF ANY HARMFUL COMPONENTS, INCLUDING BUT NOT LIMITED TO COMPUTER SOFTWARE VIRUSES. YOU HEREBY AGREE TO THE HEREINABOVE MENTIONED DISCLAIMERS.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JST ON ITS OWN BEHALF AND ON BEHALF OF ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS AND AFFILIATES EXCLUDE AND DISCLAIM LIABILITY FOR ANY LOSSES AND EXPENSES OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, GENERAL, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF USE, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, OR CLAIMS OF THIRD PARTIES, WHETHER LIABILITY IS BASED UPON CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER BASIS. YOU AGREE TO THESE DISCLAIMERS BY USE OF THE SUBSCRIPTION SERVICE. APPLICABLE LAW IN SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OF CERTAIN WARRANTIES, SO ALL OR PART OF THIS DISCLAIMER OF WARRANTIES MAY NOT APPLY TO YOU.
7. Mandatory Arbitration and Class Action Waiver
YOU AGREE THAT ANY AND ALL DISPUTES BETWEEN YOU AND JST SHALL BE SUBJECT TO BINDING ARBITRATION PURSUANT TO THE FEDERAL ARBITRATION ACT. IF THE FEDERAL ACT IS FOR ANY REASON DETERMINED NOT TO BE AVAILABLE, THE LAWS OF THE STATE OF TEXAS SHALL APPLY. THE VENUE FOR ANY SUCH ARBITRATION SHALL BE IN THE STATE OF TEXAS AND THE CITY OF FORT WORTH. YOU AGREE TO WAIVE YOUR RIGHT TO A COURT OR JURY TRIAL AND AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
10. Changes to the Service and Model
JST is engaged in ongoing research and reserves the right to modify, update, or replace the underlying trading model and its methodology at any time at our sole discretion, without prior notice. You acknowledge that such updates may result in changes to the historical performance data displayed on the Site.
